A federal customs official has declared in court he could detect through his body armor the force of a food product hurled at him by a capital city activist, who has faced court proceedings for physical attack.

Federal border agent the government official told the legal jury the sandwich "burst all over him" and he "could smell the aromatic vegetables and yellow sauce" on his official attire.

Both legal teams contests that the defendant, 37, did in fact throw vulgar language and a prepared food item at law enforcement deployed by President Donald Trump to monitor the Washington DC in the summer month.

The event was filmed on video and spread across the internet, making the defendant a figure of opposition in Washington DC to the former president.

State lawyers initially tried to obtain serious criminal counts against the accused, but a grand jury chose not to charge him.

Based on charging documents, Mr Dunn came near a group of officers at about 11 PM on 10 August, referring to them "authoritarians" and yelling: "What is your purpose? Your presence is unwanted in my city!"

The legal proceeding saw a demonstration from the officer on the trial day as he gave evidence against Mr Dunn.

"I detected it through my ballistic vest," he testified of the item's force, noting that an vegetable piece remained from his communication device and sauce marked his clothing.

The defendant's attorney, Julia Gatto, stated in her initial argument that launching the deli product was a "non-threatening act that did not, could not, cause injury".

But prosecutor the state's representative maintained the accused must be considered responsible.

"Whatever your status, you can't just go around throwing stuff at individuals because you're upset," the attorney stated.

Subsequent to the claimed attack was revealed, Mr Dunn was fired from his position as a legal assistant in the federal legal agency.
